Patient had recurrence of mass and second surgery was performed.Thereafter, she developed swelling and pain.Removal of her cast provided immediate relief of these symptoms, but one week later she began to complain of numbness, which insured attributed to cast constriction.Patient alleges second surgery was negligently performed, causing numbness in the toes.

Permanent: Major - Paraplegia, blindness, loss of two limbs, brain damage.

Patient initially presented to insured on 10-06-05 for diabetic foot care.From the initial visit over the next one year, patient was treated for multiple recurrent ulcerations of the right hallux nail bed.On 10-31-06, the granulation tissue was biopsied and sent for pathologic evaluation.Report from the pathologist was returned as showing ¿digital fibromatosis¿.This is a benign condition, which did not cause insured¿s concern.It should be noted that patient was extremely non-compliant with follow-up visits and frequently went many months between seeing insured despite appointments much sooner.Because patient continued to have drainage from the site, an x-ray and MRI were taken around April 2007.The results showed a resorption of bone, and a diagnosis of osteomyelitis was made.It was decided amputation of the distal phalanx was required, and this was performed on 05-07-07.Again, the tissue was sent for evaluation, and this time pathology revealed some possible malignant changes.The specimen was then sent to the Armed Forces Institute of Pathology who made the diagnosis of a combination of both a melanoma and a sarcoma.It is interesting to note that the pathologist documented that this was a ¿difficult case.¿Thereafter, patient underwent a hallux amputation by another doctor.It was then found she had metastatic disease.Unfortunately, she succumbed to the disease process on 04-16-08.Plaintiffs allege there was a delay in diagnosis because insured failed to perform a punch biopsy.
Severity Of Injury
Permanent: Death.
