Patient presented to insured on 12-23-05 with complaints of bone spurs, which insured treated with steroid injections.Due to her ongoing complaints of pain, surgery was performed on 02-08-07, which involved only the margins of the heel.Eighteen days after surgery, patient was doing well; however, two days later insured learned she had been hospitalized with a pulmonary embolism. Patient was seen once again in the office on 03-05-07, with no overt problem appreciated; however, when she returned two days later, there was slight dehiscence & drainage noted at the lateral wound.The area was cultured but there was no sign of infection.Shortly thereafter, patient was referred to an ID doctor due to slow healing and to insure patient did not go on to develop an infection.Patient claims she developed kidney failure due to antibiotics, PE and an infection.She alleges insured failed to recognize a free-floating bone fragment prior to the conclusion of his surgery; failed to appropriately immobilize her, which resulted in a pulmonary embolism; failed to appropriately treat an infection.Our expert stated none of the post-op films taken, including an MRI revealed any bone fragments.As to the claims of improper immobilization, he stated it was the absolute appropriate splinting and that, while the DVT was unfortunate, it was not due to insured¿s care and treatment. Insured appropriately provided wound care and appropriately cultured the wounds to insure there was no infection.There were no cultures suggestive of infection until after patient was under the care of an ID physician.Furthermore, even if antibiotics caused patient¿s kidney problems as claimed, they were handled by the ID specialist.

Permanent: Significant - Deafness, loss of limb, loss of eye, loss of one kidney or lung.
