Patient¿s prior doctor and co-defendant in this matter performed a bunionectomy on patient¿s left foot December 28, 2004.She began seeing insured on March 9, 2005, due to unhappiness with that doctor.She was seen a half-dozen times over the next 18 months by insured with various conservative treatments, and diagnosed with osteoarthritis, sesamoiditis, and capsulitis at different points.In September, 2006, insured recommended surgery, but patient cancelled the procedure and went to another doctor who performed a fusion of her 1st MPJ.Patient claims she developed AVN, and alleges insured failed to diagnose and treat her AVN, causing her unnecessary pain, as well as further surgery.Our expert found no evidence of AVN, but did find evidence of progressive arthritic change.This would be directly attributable to pre-existing loss of motion, subsequent pos-op capsulodesis and scarring, and adaptive change in the bone secondary to loss of mobility.Therefore, there is no failure on the part of the insured to recognize AVN, as it simply did not exit.The patient was appropriately treated for progressive degenerative arthrosis, which is a recognized post-op complication.
