Principal Injury Giving Rise To The Claim
Patient presented with right heel pain from playing softball. Treatment consisted of a pinpoint injection with steroids and local anesthetic.The patient was next seen twice on an urgent basis because of severe pain in his right heel; however, he admitted that he had been working and was on his foot a lot, and evidence showed no evidence of fracture.The patient was put in a walker and given pain medications, and an MRI ordered.The MRI showed a small collection of fluid in the heel superficial to the plantar fascia, which insured believed was caused from walking on it.Two days later, patient sought a second opinion, relating he had three cortisone injections in the heel without relief.The heel was aspirated and pus was noted.The patient was admitted to the hospital and a surgical I&D performed.Culture reports showed MRSA, and patient was hospitalized and placed on IV antibiotics.Patient alleges failure to diagnose by insured.Apparently, the patient had obtained two previous steroid injections from his PCP; however, he denied having a primary doctor in his history.Therefore, there is no way our insured could have been aware of these previous injections.Although our expert opined that one of the injections most certainly caused the infection, there is no way to say that it was the one performed by our insured, nor did our insured have any way of knowing two previous injections had been given.

Temporary: Minor - Infections, misset fracture, fall in hospital. Recovery delayed.
